This must have something to do with the Motions flying around the council from Lib-Dem councillor Jenny Dawe. It seems that a full investigation may actually take place, because the detail of the questions (and one knows that you don’t ask questions, unless you know the answer) seems like Ms. Dawe is spot on with some of her information. We would also request that Ms. Dawe contact us for further evidence and she may well want to add more questions.

A current motion doing the rounds is:

Terms of Motion:Edinburgh’s Lifelong Learning PartnershipThat, in order to ensure public funds can be properly accounted for, the Council instructs the Chief Executive to commission an urgent inquiry by the Council’s Internal Auditor into the operations, finances, staffing and management of Edinburgh’s Lifelong Learning Partnership and to report the results of this investigation to the April meeting of the Full Council.

That the inquiry should include investigation into:
(a) When the Council became aware that the auditors of Edinburgh’s Lifelong Learning Partnership (ELLP) had qualified their report into the accounts of ELLP in financial years 2002/3 and 2003/4.
(b) What action the Council took to ensure that the issues raised by the auditors of ELLP in respect of the ELLP accounts for financial year 2002/3 and 2003/4 were addressed.
(c) Whether the children of employees of the Council or of ELLP were employed by the ELLP, in what capacity they were employed and whether their recruitment and appointment met the standards appropriate for an arms length company significantly funded by the Council.
(d) Whether ELLP or the Council has retained control of the intellectual property rights to the concept behind “MyEdinburgh” and all trademarks, domain names and brands associated with the “MyEdinburgh” and “Cityconnnect” projects.
(e) Whether it is appropriate for employees of the Council or an organisation such as ELLP to establish, or become directors of, private companies on their own initiative and for the Council or an organisation such as ELLP to contract with that company for the provision of goods or services.
(f) Whether any employees of the Council or ELLP formed a private company known as Wabster (or Wabster IP) which was contracted by ELLP to provide information and communications technology services and whether that relationship was accordance with the ‘Nolan’ principals of public service and demonstrated Best Value.
(g) Whether individuals employed by the Council or ELLP received material benefit from their association with Wabster (or Wabster IP) and what action was taken to determine whether any benefit was received.
(h) Whether all payments made by the Council to ELLP can be properly and directly related to services actually provided to the Council by ELLP or the vouched for completion of projects for which the Council had awarded or was the conduit for grants to ELLP.
(i) Whether all payments made by ELLP for information and communications technology and related good and services provided to other organisations can be properly and directly related to services satisfactorily provided to those organisations.
(j) Which Council officials served as Directors or Company Secretary of ELLP and what were their periods of office.
(k) Which employees of the Council were seconded to work for ELLP, when were they seconded, what were the terms of their secondment and when did those secondments end.
(l) Why there have been no annual reports to the Executive on the work of Edinburgh’s Lifelong Learning Partnership as is normal for arms length companies established by the Council and funded significantly by it.
We are being a bit presumptious here, but we would assume that when all those questions have been answered then the whole dossier will then be passed to the Chief Constable for referral to the Procurator Fiscal.
