We have, without doubt, met all contractually agreed conditions and Bilfinger Berger are trying to rip us off.

The headline is what we are waiting to hear from TIE and the City of Edinburgh Council. If TIE have not met all contractually agreed conditions then the German project management company have every right to demand a renegotiation of the contract. When TIE signed the the FIXED PRICE CONTRACT that fixed price would have included that TIE meet certain contractually agreed conditions for that price to be valid. If TIE do not meet those contractually agreed conditions then the Bilfinger Berger’s fixed price goes exactly the same way as the conditions that TIE had agreed. It is called business.

Then in today’s Scotsman our Leader, Jenny Dawg comes out with the humdinger: However, Ms Dawe said: “Bilfinger’s job is essentially to project-manage the infrastructure works. I would have thought it would have been fairly easy to get another company in to do that in the current climate.”

The council have spent all weekend blaming Bilfinger Berger but not one mention of whether they have met all their contractually agreed conditions. Why?

The CEO of TIE resigned just a few months ago taking a huge wedge of cash in his back pocket. It now looks as though he knew exactly what he was doing – he would have known on the day of his departure whether the council had or were able to meet all of those contractually agreed conditions. Why doesn’t any of the many journalists covering this get on the blower to him. Wethinks TIE are crap and a half.

Of course remember the last we heard from the latest incompetent head of transport in the Council, Lip (the Liar) Wheeler – It’s on time and on budget.
