Constituent sends his Constituent’s Contract – Update I

An Edinburgh constituent has today emailed all parties standing in the European Elections in Scotland asking that their candidates sign a contract with him. The contract which includes articles stating that resignation is required in certain circumstances has now been circulated to all candidates standing in the Elections in Scotland with the following covering email:

In furtherance of my due dilligence for the upcoming European elections, please find attached a Constituents Contract I wish to have signed by candidates running for your party in Scotland. I would like this to enable me to decide which party to vote for.

Candidates are allowed to either sign the contract in full or they may add/delete at will.

Please return the signed contract to me at the following address:

The contract consists of the following:

Constituents Contract

I, as candidate in the European Elections hereby agree to the following contract with my constituent, xxxxxxxxxxxxxxx:

  • I will remain a fiercely loyal representative for my constituents. I will not put any party before my constituents. If I do, I will resign.
  • I will work with any organisation in Scotland, the UK or Europe if it will help the people of Scotland.
  • I will never promise what I know I cannot deliver.
  • I will acknowledge all letters from constituents within 24 hours between Monday and Friday.
  • I will acknowledge all emails from constituents within 24 hours between Monday and Friday but hopefully sooner.
  • I will attend regular advice/consultation sessions which will be widely advertised in the constituency. I will arrange home visits for the elderly, disabled and carers.
  • I will never knowingly claim credit for something when the credit is not mine.
  • I will tell people my real views, even when I know they will disagree with me.
  • I will do my best to keep my website updated every day. I will blog regularly.
  • My calendar will be published on my website and kept up to date daily from Monday to Friday.
  • I will not claim one penny in expenses that is not absolutely required for me to carry out my job as an MEP. If I do not keep this pledge, I will resign.
  • I will publish my expenses, in full, monthly or possibly weekly on my website. If I do not keep this pledge, I will resign.
  • I will not use any taxpayer funded equipment or office for any other reason that to carry out my duties of MEP. If I do not keep this pledge, I will resign.
  • I will have no problems being a whistleblower against anyone. In this, I will not be anonymous and I will use the press. If I am caught knowing about illegality or sleaze and not whistle blowing, I will resign.
  • I will continue to live in the constituency, among the community I serve. If I move from the constituency, I will resign.
  • I will be a full time MEP with no jobs outside politics nor will I take any money from anyone outside politics. If I do work for anyone, it will be on a voluntary basis which will not infringe on my time as an MEP.

UPDATE I
It seems 24 hours later and only one reply to the Constituents Contract. This comes from Jury Team’s Alan Wallace:

1) I’ve amended the responding in 24 hrs part to take into account that I may be ill or on holiday sometimes.
2) My schedule will be updated regularly, but I can’t take into account last minute changes.
3) Whistleblowing. With this point I know exactly where you are coming from, but attendance at some meetings is conditional upon a privacy agreement. Indeed, some may be part of the Official Secrets Act. If & when I discover wrongdoing that it is in the public interest to reveal, I will do so and hell mend them, but I have to balance this with the fact that if I’m shouting about tittle tattle that is actually small beer I will certainly find myself barred from further meetings and so unable to discover more. This was exactly the problem that Martin Bell had. After a while, he stopped being invited onto committees and into meetings. Effectively, he was frozen out. To find out what’s going on behind closed doors, you have to get the other side of the doors if you see what I mean.

UPDATE I
A second contract has been returned and this one from Johanna Dind of the Scottish Socialist Party. Interestingly, on their website she is in the same constituency as Nigel (Does my willy look big in this camera) Griffiths.

  1. None of them will answer or sign that contract. It cuts out everything they are in politics for. Some hope – I bet they don’t even hear back from any of them.

  2. Anyone who signed that charter would be totally barking. They would also be lying, as by signing it they already break the third clause – to never promise anything they know they cannot deliver.

    The constituency for an MEP is …um…the whole of Scotland, so an MEP could live in Orkney and still be ‘local’. Home visits? Brilliant idea but how practical are they when your constituency’s the whole of Scotland?

  3. I think I agree with both of you. However, they have been given an out in the covering letter/email “Candidates are allowed to either sign the contract in full or they may add/delete at will.”

    It is a good start to hold politicians to account. Now…. If this could be made legal!!!!! WOW!

  4. I note your cynicism chaps, but Jury Team really is different. For a start, I have already signed a witnessed & legally binding agreement that states I will adhere strictly to the Nolan Principles of Public Life – Selflessness, Integrity, Objectivity, Accountability, Openness, Honesty and Leadership. If I contravene any of those points whilst an MEP, Jury Team WILL sue me.

    Am I barking? Am I lying? No. You miss the point that all the Independents standing with the support of Jury Team are doing so because we are passionate about cleaning up politics.

    Note that I have published the contract myself, with the addition that I will never submit to a party whip.

  6. Hello,

    I am standing as an independent in the Euro Election under the Jury Team banner the same as
    Alan Wallace. (I am standing in the East Mids)
    Alan told me he was signing this and sent me the link.
    It doesn’t surprise me that Alan has signed up as he has impressed me as a very principled candidate.

    I will think about signing, but must admit that whilst i agree wholeheartedly with most points i am a little worried that-
    “I will never promise what I know I cannot deliver.”
    conflicts with -
    “I will acknowledge all letters (and emails) from constituents within 24 hours between Monday and Friday.”
    As i have no idea how many letters/emails i will receive nor what hours i will be in session, committee or busy travelling in any 24 hour period.

  8. Well done the Basa for this initiative. I am a Jury Team candidate for the North West.

    I have adapated the contract in some ways and ,importantly, to make it binding in law – yours was just a non-binding promise that would be next to impossible to enforce. You need ‘consideration’ by the constituent, ie something he agrees to do in return. I considered making this the vote but then felt this not proper and difficult to prove so instead replaced by posting a message and link to the contract.

    I have also included a process for forcing my resignation by order of court if necessary.

    Since Cameron has over the past few days plagiarised the Jury Team principles maybe he will copy this also and then you will have started the greatest change in British politics since women were given the vote.
